I think if an MD-9600 is modified with the OpenGD77 firmware, it is no longer in compliant with FCC's Type Acceptance with the radio (under the Type 90 / 95 etc that is required for commercial, GMRS etc service), and thus, not legal to transmit on those frequencies. I think the TYT radio might have gained Type Acceptance w/ the FCC, but only if it is kept unmodified, and firmware modification is considered a modified radio.
This applies to any firmware that you load onto any radio, apart from the firmware supplied by the manufacturer, which the FCC has approved.
We occasionally get people posting to the forum, asking questions about using the firmware as part of their commercial operations.
And on each occasion, we have to remind them, that apart from the license on the firmware which states Non Commerial only, they will also be breaking various laws if they use the radio with non-official firmware installed on it
