I thought it was important to inform you that Aliexpress is selling DM1701 radios with opengd77. I don't know if this practice is legal and if the developers have this information. Soon I decided to warn in this comment.

Re: Rádio DM1701 vendido com OPENGD77
Looking at the listing all it is saying is that the radio is compatible with OpenGD77. It doesn't say that it is pre-loaded.

Re: Rádio DM1701 vendido com OPENGD77
At least one person who posted to the forum seems to be using a radio which had OpenGD77 pre-installed onto a DM1701
Its impossible for us to prevent this, especially because these vendors are in China, which doesn't have effective IP laws, and its not actually in breach of the license.
The license does not allow commerical usage of the firmware, but this is not necessarily commercial usage, and if the cost for the radio with OpenGD77 is the same as for the official firmware, then the vendor is not making any money from the firmware.
What is more concerning, but again outside of our control, is that non-hams are buying these radios, and using them for either commercial use or other not for profit use.
The commercial use is in breach of the license
And any non-ham use is illegal becuase installation of the firmware invalidates FCC and all other certification of the radio, because we don't use the hardware within the limits of the official firmware e.g. you can operate on a wider frequency range, you can also set the PA power beyond its specified operating limits etc etc
So its not IP laws which are being broken its laws which are enforced by the radio communications agency in each country. e.g. FCC, Offcom , ACMA etc etc
But this is not much different from when people buy any Baofeng running the official firmware, and use it on UHF CB or Personal radio band,.
